20-10-2014 - Heard the parties and perused the Lower Forum records for final disposal.
2. This appeal has been filed against the order dated 21.4.2014 passed in Complaint Case no. 61/14 dismissing the complaint on the ground that it was barred by limitation.

Mr. Ajay Kumar, the complainant appearing in person submits that in the complaint petition, it was stated that several complaints were made and a complaint through E-mail was made on 30th September, 2013. A copy of the E-mail was also filed before the learned Lower Forum on 16.4.2014 but it appears that the same was not considered by learned Lower Forum.
4. Learned counsel for the respondents on the other hand supported the order under appeal and submitted that the complaint was vague and it was rightly dismissed as time barred.
5. The complainant purchased a Television set from the respondents on 3.11.2010. According to the complainant after about 8-10 months some trouble started in the Television about which he made several complaints and he also made complaint through Net, on 30th September, 2013. The complaint was filed on 9.4.2013.
6. In our opinion, the complaint was not time barred. Accordingly the impugned order is set aside and the Complaint Case no. 61/14 is restored to its original file. The parties are directed to appear before the learned Lower Forum at 11 A.M. on 17th November, 2014.
7. The learned Lower Forum will fix next date (s) and will decide the case on merits in accordance with law. This appeal stands disposed of.
