The Revision Petitioner is the complainant in OP.315/05 in the file of CDRF, Thiruvananthapuram.  The order sought to be revised is the observation of the Forum that the issue of maintainability will be considered along with final hearing after taking evidence of the opposite parties.  The Forum has posted the matter for evidence of the opposite parties.

It is the contention of the Revision Petitioner/complainant that in fact the opposite parties had not filed version and that the opposite parties somehow managed to place the version in the case bundle surreptitiously.  The Revision Petitioner has also produced copy of the proceedings paper.  It is admitted by the Revision Petitioner that the complainant was cross-examined by the opposite parties.  In the order sought to be revised the Forum has mentioned that version is seen in the case bundle.  We find that the Revision Petitioner/complainant ought not to have permitted the opposite party to cross-examine the complainant in the absence of version.  It is seen noted in the proceedings paper at certain pages that the matter is posted for additional version also.  We find that he matter is of the year 2005.  In the circumstances we are inclined to dispose of the matter with the direction to the Forum to hold an enquiry as to the allegation of the complainant that the version was inserted in the case bundle unauthorisedly.  It is also submitted by the counsel for the Revision Petitioner that he has not been served with the copy of the version.  The Forum will see a copy of the version is given to the complainant and then only proceed with the evidence of the opposite parties.  Being an old matter the Forum will dispose of the case at the earliest at any rate within 4 months from the date of receipt of this order.  The Revision Petition is disposed of accordingly.

  A copy of this order will be forwarded to the Forum urgently.
