The case of the complainant is that complainant had purchased Horlicks Ods from the first opposite party. The very same night the complainant and his family members used to drink the Horlicks Ods, after having the Ods they felt vomiting and motion; due to the incident complainant became tired and rest less. The incident happened due to the negligence of the opposite party No.1 & 2. Therefore complainant is seeking relief against the opposite parties , directing them to return the actual price of the Horlicks ods and also pay compensation.
Opposite party No.1 after serving notice not appeared before this Fora, Opposite party No2 notice served and appeared through Adv.Prasad. Complainant was continuously absent for the last 3 consecutive postings. Even though complainant was absent it is learned from the first opposite party that matter settled between the parties, in all postings Opposite party No.2 represented through a counsel; complainant also not informed before this Fora regarding the settlement. Any way complainant continuously absent for the last 3 consecutive postings, no document was seen produced along with the complaint. On perusal of complaint itself no merit in this case without producing the purchase bill and material object , fora can not consider the complaint above. More over opposite party No.2 represented through the counsel in all effective postings, complainant evaded from the proceedings, it shows no merit in his complaint. There fore complaint is dismissed without any cost.
