Final Order / Judgement

This case was posted for today for passing final order. On 01.08.2022 the complainant appeared before the Commission and submitted that the partition of the land for which the instant complaint was filed by the complainant was allowed by the opposite party much earlier and as such the complainant is not willing to proceed further with the case. Hearing the complainant he was directed by this Commission to produce certificate of partition/copy of Jamabandi along with a petition to dispose the case. Accordingly on 12.08.2022 the complainant filed petition No.158/22 stating that the partition of the land was done on 01.11.2017 and as the purpose has been served, the complainant is no more interested to proceed with the case further. He has also submitted the Jamabandi of the concerned land in question. From perusal of which it seems that vide order dtd. 01.11.2017 of the Circle Officer, Dibrugarh East Revenue Circle, the land measuring 1 Katha covered by Dag No.286 has been separated from this Dag and allowing partition of Salauddin Ahmed was allowed by making a new Dag No.378 under PP No.150.

 From perusal of Jamabandi and order thereon, it seems that the partition sought for by the complainant was allowed by the Circle Officer, Dibrugarh East Revenue Circle on 01.11.2017 and the complainant filed the instant case on 07.11.2017, almost a week later than the partition order was passed. Under the above circumstance and on the basis of the petition No.158/22 filed by the complainant, the withdrawal of the case is allowed.

The case is dropped on withdrawal by the complainant.
