Complainant files this case U/S 35 of Consumer Protection Act 2019 and complainant stated that he entered into an agreement with the OP for institution of mobile telephone and net tower in the scheduled property for commercial purpose and to get financial benefit.

Now it is alleged that the OP did not pay the monthly rent to the complainant hence, this case.

On a close scrutiny of the materials on record and also considering the position of Law of C.P Act 2019 it is crystal clear that the complainant cannot be considered as a Consumer within the ambit of C.P Act 2019. So, this petition of complaint is not tenable before this Consumer Commission.

 

Hence, the same is liable to be dismissed.

            Hence, it is,

                        Ordered,

                                    that the instant Case No. 48/2022 be and the same is dismissed.

Copy of this order be supplied to the parties each at free of cost.
