ORDER

Heard both the parties. The shirt produced by the complainant is examined by the Forum. It is found that the colour of the shirt was faded at a few places. The advocate for the opposite party was present. He also admitted the bill was issued by the opposite party and Rs.108/- was charged for No.3 item. The stand taken by the opposite party was that the alleged defect was caused by the detergent used for washing and it was not due to material defect. After looking at the material, the Forum had come to the conclusion that it was the manufacturing defect and that presumption had not been rebutted by the O.P. It was also not proved by the opposite party that the defect was caused by the detergent used for washing. This is a clear case of deficiency in service rendered by the respondent. Hence the Forum has awarded the following compensation to the complainant. 1. To refund Rs.158/-(with interest at 10% p.a. from 27.03.1993 till the date of payment. 2. Court cost Rs.100/-.
