ORDER

The complainant has filed the present complaint under Section 12 of Consumer Protection Act, 1986, with the averments that the vehicle of complainant TATA LPT-1109 bearing registration No.HR64-2433, Engine No.31458, chassis No.125863 Tata was insured with the Ops vide cover note No.8558099 valid w.e.f. 17.09.2011 to 16.09.2012. It is alleged that on 30.07.2012, the offending vehicle bearing truck No.HR58A-5377 dashed against the Eicher canter No.HR-64-2433 in the area of Hisar Road This way, the Ops are deficient in service. Hence, this complaint is filed.
2. Upon notice, the opposite parties appeared before this forum and filed written statement raising preliminary objections with regard to On merits, the contents of complaint are denied and so, prayed for dismissal of complaint.

4. We have heard ld. counsel for both the parties and perused the case file carefully and minutely.
5. We have perused the complaint & reply thereto and also have gone through the evidence led by the parties.
