ORDER

Vishav Bharti Public School vs. Cholamandalam DBS Finance Ltd. etc.

CC No. 50 of 2013.

 

Present: Sh. P.P.Saini, Advocate, counsel for complainant.

              Sh. Jasbir Singh, GPA Cholamandalam with counsel Sh. Neeraj Rajoria.

 

                        Counsel for the complainant made a statement recorded separately that compromise has been effected with the OPs for Rs. 30,000/- as full and final payment and they have made the payment of Rs. 30,000/- in cash to the OPs in the Forum. According to loan agreement No. KMLM242585 ID No. 90410881 they have made the payment today and prayed for directing the OPs to issue NOC, Form No.35 and other documents required for cancellation of HPA.

                        On the other hand, authorize GPA Jasbir Singh made a statement that he has received an amount of  Rs. 30,000/- on behalf of OPs as full and final payment from the complainant counsel and nothing is due. He further stated that they will provide NOC or Form No.35 alongwith other required documents within a period of 30 days. Copy of GPA is on the file as Annexure R-1.

                        Counsel for the complainant made a statement that in view of the compromise and aforesaid statement made by GPA, he withdraws the present complaint, which may be filed.

                        In view of the aforesaid statement made by both the parties, the present complaint stands disposed off accordingly. However, the OPs are hereby directed to handover the NOC, Form No.35 alongwith necessary documents for cancellation of HPA  to the complainant within a period of one month positively. Both the parties are bound by their statement made in the Forum. Copies of this order be sent to the parties concerned free of costs as per rules. File be consigned to the record room after due compliance.
