CONSUMER COMPLAINT NO. 179  OF  2021

ORDER

1.        At this stage, vide his separate statement, Sh.J.P.Nahar, Counsel for OPs has stated that the matter has been settled between the parties with the term that OPs shall pay sum of Rs.15 Lakhs towards Personal Accident Claim to the complainants by way of demand drafts in favour of both the complainants i.e. Mina Devi @ Meena Devi & Krishna Singh within a period of 45 days from today failing which the OPs shall be liable to pay the aforesaid amount alongwith interest @ 9% p.a. from the date of the decision of this complaint. Vide his separate statement, Sh.Madan Singh Dasila, Counsel for Complainants has admitted the aforesaid statement of counsel for OPs and prayed that the complaint be disposed off in terms of aforesaid settlement.

2.        In view of the aforesaid statements and in terms of the settlement, the complaint stands disposed off by passing the following order:-

     (i)  OPs shall pay sum of Rs.15 Lakh towards Personal     Accident Claim to the complainants by way of demand drafts within 45 days from today i.e. 02.01.2023 and the aforesaid amount of Rs.15 Lakh shall be proportioned in      the following manner:-

          (a)  Rs.9 Lakh to complainant No.1.

          (b)  Rs.6 Lakh to complainant No.2.

     (ii) In case the aforesaid amount is not paid by the OPs within the stipulated period, then OPs shall be liable     to pay the same alongwith interest @ 9% p.a. from      today i.e. 02.01.2023 till its realization.

3.   The complaint is disposed off accordingly.

4.   Certified copies of this order be sent to the parties free of cost. The file be consigned.
