                                                                                            JUDGMENT

            Complainant has filed the consumer complaint U/s.35 of Consumer Protection Act, 2019 on 12.9.2022 but proceeding under Arbitration & Conciliation act, 1996 was initiated on 26.4.2022 and section 17 notice was issued.

            Since Arbitration proceeding has been initiated prior to filing of consumer complaint i.e. on 12.9.2022. Hence the consumer complaint is dismissed. However if the complainant makes an application for OTS as prayed by counsel for complainant, then the same may be considered sympathetically by deducting 2/3^rd overdue charges/interest (ODI). No cost.
