Present:     None for the complainant.

Sh. Neeraj Rajoria, Adv. for the Op.

Case called again after lunch-break but neither the complainant nor his counsel has put in appearance.  Waited sufficiently.  It is already 3:30 p.m.  No intimation regarding absence of complainant is received.  From the perusal of the case file, it has been revealed that earlier the case was fixed for the evidence of complainant on 02.08.2017.  The following order was passed on 02.08.2017:-

“Adjourned at the request of the counsel for the complainant to 08.09.2017 for filing CWs, subject to the last opportunity failing which evidence of the complainant will be closed by court order.”

Thereafter, the case was taken-up for hearing on 08.09.2017.  The complainant did not appear on the said date and the following order was passed on 08.09.2017:-

“Adjourned to 17.10.2017 for filing evidence of the complainant subject to the last opportunity.  No further adjournment will be given for this purpose.”

The present case pertains to the year 2015.  So, it seems that the complainant is not serious in pursuing the complaint.  Thus, the present

                                                                -2-  Gurmeet Singh Vs. Cholamandlam

complaint is hereby dismissed in  default.  File be consigned to the record-room after due compliance.
