The record is put up by petition along with the prayer for disposal of the case on the ground stated therein.
Both the Complainant and the representative of O.P./Investment & Finance Company are present.
The case is set for Ex-Parte hearing on 14-11-2022 in default of filing Written Version but both parties have come today before the Commission with positive mind for disposal of the case. O.P. is an Investment & Finance Company having sanctioned loan in favour of the Complainant for purchase of Bolero Pick Up Van bearing Registration No.WB 67A 7482 and the loan has already been repaid but the O.P.s are not issuing N.O.C. This has led the Complainant to file this case to get the N.O.C. from the O.P. claiming compensation of Rs.30,000/- for harassment.
The O.P. is ready to hand over the N.O.C to the Complainant but the Company is not willing to pay any compensation. In course of hearing the Complainant and the O.P. authority took up the matter with the Head of O.P. authority over telephone though the O.P. Company is not determined at this stage to pay any compensation but they may consider the same if the matter is left to their discretation. Contd……p/2

Considering the entire facts and circumstances of the case and long pendency the Commission thinks it just and proper to dispose of the case today by directing the O.P. to hand over the N.O.C. to the Complainant on proper receipt leaving the matter of compensation with the discretion of the O.P.authority keeping in mind that the amount of compensation should be reasonable and acceptable to the Complainant.
In terms of the Order above the Representative of the O.P. Company has handed over the N.O.C. to the Complainant who received the same on proper receipt by putting his signature in the Order sheet .
Hence it is ordered
That the case is disposed of accordingly in the light of above observation with the direction to O.P. to exercise the discretion of paying compensation at the earliest.
Let a copy of this order be handed over to both parties free of cost.
