Upon considering his submissions and on thorough scrutiny of the entire materials on record, we find that the complainant cannot be termed as ‘consumer’ as per the definition laid down in the relevant Act. Hence, question of unfair trade practice towards the consumer as has been alleged by complainant does not arise since complainant is not at all a consumer.

It appears from the record that the allegations and the matter in question as stated in the petition of complaint is purely in criminal in nature and it is prudent to adjudicate the matter before the competent criminal court of law.

In view of the above, the instant complaint petition is rejected summarily and complainant is at liberty to agitate the issue on the self same cause of action before the competent court of law.
