Sunil son of Sh. Jagdish resident of ward no.2, Jal Singh colony, Gharaunda, tehsil Gharaunda, district Karnal.

Cholamandalam Investment and Finance Company Ltd., SCO-193, Sector-12, HUDA market, near health freak cafe, mini Secretariate, Sector-12, Karnal through its authorized signatory.

Complaint under Section 35 of Consumer Protection Act, 2019.

Present:  Sh. Sunil Kumar, complainant in person alongwith Sh. Naresh Sharma, Advocate.

                Sh. Sunny Saini, G.P.A., Holder Cholamandalam Investment and Finance Company Limited alongwith Sh. Dheeraj Sachdeva, Advocate.

 

                Today the case is fixed for notice of the OP. Power of attorney filed on behalf of the OP.

                At this stage, Sunny Saini, G.P.A. Holder Cholamandalam Investment and Finance Company limited, OP suffered his separate statement to the effect that, the matter has been compromised with the complainant, company is ready to receive the Rs.28,705/- as default amount if the same be paid within three months alongwith regular remaining monthly installments. At the time of final settlement, company will give rebate to the complainant on the penalty amount and interest.

          On the other hand, complainant suffered has separate statement to the effect that he is ready to pay the defaulting amount of Rs.28,705/- and withdraws the complaint and reserve his right to file a fresh complaint, if the company forcibly tries to take the possession of the vehicle in question.

              In view of the above statements, the present complaint is dismissed as withdrawn. Both parties are bound by their statements. Parties concerned be communicated of the order accordingly and file be consigned to the record room.
