ORDER
The matter is listed for hearing on 10/1/2011. However, on the basis of written request made by the Learned Advocate for the Complainant, today the matter is taken on board.
[2] The Complainant in person is present alsongwith his learned advocate. Mr. Manmohan Sharma, authorized representative of the Opposite Party No.2 is also present. The parties state before this Forum that the dispute between them has been amicably settled outside the Forum. They have produced on the record Consent Terms to that effect. These consent terms bear the signatures of the Complainant as well as his advocate and Mr. Manmohan Sharma for and on behalf of the Opposite Party No.2. The Complainant states that he does not wish to prosecute the complaint, as against the Opposite Party No.1 – Insurance Company. The Complainant made a statement at the bar to the effect that he shall have no objection if the complaint is disposed of in accordance with the Consent Terms. Representative of the Opposite Party No.2 states that the Opposite Party No.2 shall have no objection if in case, the Complainant is permitted to withdraw the amount in sum of Rs.73,000/- deposited with this Forum in pursuance of the interim order dtd.2/7/2010, passed by this Forum.
In these circumstances, the complaint stands disposed of. Consent terms executed between the Complainant and the Opposite Party No.2 and filed on the record of this Forum on 20/11/2010 shall form part & parcel of this order. The Complainant is hereby permitted to withdraw an amount in sum of Rs.73,000/-, deposited with this Forum in pursuance of the interim order dtd.2/7/2010. Registrar of this Forum is directed to release the amount in favour of the Complainant upon obtaining an application to that effect from the Complainant. No order as to costs.
