1. This order shall dispose off an application filed by the Complainant for restoration of the case. We have heard the Ld. Counsel for the Applicant/Complainant and have perused the file. The case of the Applicant is that the case was dismissed for non-prosecution on 08.05.2023. It is the case of the Applicant that his previous Counsel did not apprised the Complainant regarding the proceedings.
2. The perusal of the file shows that the Counsel for the Complainant has appeared lastly on 22.07.2022. Thereafter on 08.09.2022, 09.11.2022, 09.01.2023, 16.03.2023, 31.03.2023 and 08.05.2023 none has appeared on behalf of the Complainant. Neither the Complainant nor any Advocate on his behalf has appeared for six consecutive dates. No sufficient reason has been assigned in the application for such a  long absence. The application is not even supported by the affidavit of the Complainant. We do not see any merit in the application and the same is dismissed.
3. Order announced on 03.11.2023.

Copy of this order be given to the Complainant at free of cost
