Today learned counsel for the complainant again requested for an adjournment to tender the evidence . On the perusal of the file it came to our notice that the counsel for complainant has taken ample opportunities for tendering the evidence but no evidence has been produced by the complainant despite last opportunity. No justification for further adjournment. It seems that the comlainant is not interested to persue the present complaint seriously. Therefore, the present complaint is dismissed for want of prosecution evidence under Order 17 Rule 3 CPC. However, no order as to costs or compensation. Copy of the order be supplied to the parties free of costs. File be consigned to the records after due compliance.
