Counsel for the respondent has produced on record copy of the stay order dt.24.3.2015 passed by the Hon'ble State Commission vide which the operation of the impugned order under appeal is stayed subject to deposit of 50% amount, so awarded by the District Forum after deducting therefrom, the amount already deposited by the appellant at the time of filing of appeal. Counsel for the respondent has also produced on record copy of the receipt of Rs.126210/- deposited in the Hon'ble State Commission at the time of filing of appeal. In view of the stay order passed by the Hon'ble State Commission, Sh.Vinay Khera,Adv.counsel for the applicant got recorded his statement that he withdraws the present execution application without prejudice to my right and to file a fresh execution application after the decision of appeal before the Hon'ble State Commission. Resultantly, present execution application is dismissed as withdrawn. However, the applicant is at liberty to file a fresh execution application after the decision of appeal before the Hon'ble State Commission. File is ordered to be consigned to the record room.
