The case filed by the complainant with the allegation that he purchased 2 Badminton Rackets from Chiku Sports at a price of Rs. 900/- i/e Rs. 450/- each.

The said purchase was made on 06/12/2015.

The said Rackets were found some technical problems .i/e stick of the racket became bend to some extent .

Accordingly, the complainant prayed for issuance of notice against the o.ps .

On perusal of the documents filed by the complainant it appears that there is no warrantee card in respect of those rackets. Apart from the said fact , the complainant did not inform anything to the seller in respect of the defects of the said rackets .

In view of the fact , we hold that , the complainant failed to prove that , there was defect in those rackets at the time of purchase or due to wrong handling of those rackets , the said defects arose .

In view of the said fact , we do not find any merit to issue notice against the o.ps .

As such, the case dismissed accordingly.
