Final Order / Judgement

Heard the Learned Counsel for the complainant and OP 1 present. Perused the material available on record. On dt.24.01.2024 the Complainant filed a memo stating therein that the Op 2 has returned back the amount of Rs.60110.46 by way of transfer to his account  on dt.1.12.2023 which the Ops had deducted from the account of the complainant of Rs.61,274/- up to 31.08.2023. The balance amount of Rs.1,164/- with interest has not yet been transferred. However, the complainant has further prayed for a direction to the OPs to return back the balance amount of Rs.1,164/- along with interest and compensation to the complainant.

Here the complainant  has alleged that the OP bank has deducted the transaction charge from 1.1.2021 to 13.2.2023 for an amount of Rs.37078/- from the saving account of the complainant on different occasion arbitrarily causing financial loss and mental agony to him.

 It is found that  on receiving of notice of this complaint the Op2 has returned back the amount of Rs.60,110.46 by way of transferred to the account of the complainant on 1.12.2023. But the complainant as on date has claimed balance amount of Rs.1,164/- to be restored to his saving bank account by the Ops .

We found nothing pleaded or prima facie proof that the said amount of Rs.1,164/- has been unauthorizedly deducted by the Ops from the SB Account of the complainant.  Rather the grievance of the complainant has already been complied by the Ops as on date as such we do not think proper to proceed any more in this case. Accordingly this complaint  is dismissed  against the Ops as complied. However, no order as to cost.
