The short case of the complainant is that she had deposited Rs. 30,000/- on 23.04.2013 with the Opposite Party through their agent for an Insurance Policy named as “Guaranteed Wealth Plan” vide policy No. 006094308. The complainant received the policy document after one month of submission of application and found that the photograph as shown on the body of the policy is not of her but any other person. Thereafter the complainant reported the matter to the Opposite Party and requested him either to rectify the defects or cancel the policy but the request of the complainant could not attend. Due not deficiency in service on the part of the Opposite Party the complainant filed present complaint.

The Opposite party appeared through his Counsel and denied his liabilities by filing his written version.

It is not disputed that the photograph which was affixed in the policy bond is not of the complainant but was of some one. Due to issue of wrong policy issued by the Opposite Party affixing a photo of another person, the complainant neither withdrew the policy within “Free Look Period” of 15 days nor could continue the policy on payment of premiums. Issue of a policy affixing the photograph of someone person other than the complainant is a clear case of deficiency in service.

We direct the Opposite party to refund Rs. 30,000/- with 12% interest till repayment. We also award harassment damages of Rs. 3,000/- inclusive of litigation expenses.

The order shall be complied within 30 days of the receipt of the copy of the order, otherwise action can be taken under Section 25 / 27 of the Consumer Protection Act.

Copy of the order be sent to the parties free of cost.
