Today is fixed for S.R. and A/D.

A.D. Card of notices sent to O.P. no.1, 2 & 4 have been received after service.

No S/R of notice sent to O.P. no.3 has been received.

Sri Kali Santosh Chattopadhyay / Complainant is found physically present by filing his hazira and he submits before us interalia that the dispute as alleged in this case has been settled and the entire amount, for which he has to file this case, has been paid to him.  As such he does not want to proceed with this case and prays for dismissal of this case for non-prosecution.

Complainant also files petition in this regard stating said fact.

Heard the Complainant. 

Perused the petition and materials on record. It appears that this Complainant does not want to proceed with this case as the dispute as alleged in this case has been settled for that he does not want to proceed with this case.

In view of the circumstances we find no impediment to dismiss this case for non-prosecution on the basis of prayer made by the Complainant.

Hence,  it is

That the complaint be and same is hereby dismissed for non-prosecution but without cost.

Let a plain copy be supplied to the Complainant free of cost.

Thus the complaint case is dismissed of.
