Both parties are present. The consumer complaint is taken up for hearing.

 On perusal of the record and the submissions of the ld. Counsels appearing for the parties it is appearing that petitioners have moved this forum for a relief against the o.p. for a direction upon them to hand over the title deed of the premises no.9A, Justice Chandra Madhab Road, Kolkata alleging deficiency in service on the ground o.p. has neglected to return the deed. In spite of the fact petitioners are ready and willing to deposit the balance amount of the loan obtained by the deceased husband and father.

It is evident and admitted fact that for recovery of the loan o.p. filed a title suit being no.65 of 94 which is decreed in preliminary form and against the preliminary complainant moved the Hon’ble High Court in first appeal. That appeal is pending and suit is also pending. The title suit in question is lying before the Civil Court. The suit is awarding find decree.

In that case this forum cannon invoke their jurisdiction to entertain the dispute as alleged by the petitioner. Accordingly present consumer complaint is disposed of. Petitioners are directed to move the appropriate forum for relief.
