Final Order / Judgement

 

This case record is put up today on the strength of a compromise petition filed by the complainant and the Op.No.3. Parties to the present dispute and are present alongwith their respective A/Rs. Parties have submitted that they have settled their disputes out of Court and complainant does not want to proceed further against the Opp. Parties and prayed to dispose the case accordingly.

Perused the case record and material documents available therein and ascertained that the complainant has filed the present case against Opp. Parties claiming reliefs as per her claim petition. It is also ascertained that Sasmita Das @ Majumdar (OP.No.3) has already withdrawn an amount of Rs. 2 Lakhs out of total amount of Rs. 30 Lakhs and the balance amount of Rs. 28 Lakhs was kept as fixed Deposit in the name of Sasmita Das @ Majumdar and the said Fixed Deposit was held up by the State Bank of India, Malkangiri Branch (Opp.Party No. 1) due to the dispute arose between the parties. It is also ascertained from the petition for compromise dated 10.04.2021 filed by the parties that on the intervention of their well wishers and gentlemen, parties have settled their disputes as per the agreement made between them as mentioned in the petition for compromise and also ascertained the complainant does not want to proceed further against the Opp. Parties being the dispute amicably settled and fully satisfied. Hence this order.

The Opp. Party No. &2 i.e. Chief Manager, SBI, Malkangiri Branch and Sri Sagar Nayak, Credit Monitoring Officer of Op.No.1 are herewith directed to release the disputed amount of Rs. 28 Lakhs in favour of the Opp. Party No.3 namely Sasmita Das @ Manjumdar with the following terms that :-

  1. Rs. 10 Lakhs to be credited in to the saving account of Sabita Das,
  2. Rs. 10 Lakhs to be kept as fixed Deposed in the name of Minakshi Das, aged about 4 years, daughter of Sasmita Das @ Majumdar and Late Manindra Das, and the granddaughter of Sabita Das and the said amount shall be released and disbursed to Minakshi Das after she attains her majority,
  3. Rs. 8 Lakhs to be credited into the saving account of Sasmita Das @ Majumdar, respectively.

The petition for compromise dated 10.04.2021 shall be read as a part of this order.

With the above direction, the present case is disposed off accordingly.
