Md. Khairul Alam filed a consumer case on 30 May 2023 against Chief Manager, SBI, Suri Branch in the Birbhum Consumer Court. The case no is CC/75/2020 and the judgment uploaded on 31 May 2023.
In epitome complaint case is that he deposited Rs. 51,000/- as fixed deposit with OP/Bank for the period of eight years vide CIF No. 8091143505-6, 8595991347-4 and the maturity date was on 18/10/2019 and the maturity amount was Rs. 1,05,996/-. But on maturity complainant was paid Rs. 1,01,290/- resulting which complainant instituted this case again OP/Bank and complainant accordingly has prayed for direction upon OP/Bank to pay Rs. 4,706/- to the complainant along with interest @ 12% since 18/10/2019. Complainant also has prayed for compensation of Rs. 15,000/- towards causing damages and mental agony and also complainant has prayed for litigation cost of Rs. 10,000/-.

It may be noted that in this case in spite of service of notice OP did not appear to contest the case resulting which case has been proceeded exparte hearing against the OP/Bank.

Only point to be decided whether complainant is entitled to have the decree as prayed for ?

Going through the evidence of complaint it may be noted that the contents of the same appears to be a replica of the contents of petition of complaint.
It may further be noted that at this stage going through the unchallenged testimony of the complainant there is nothing to disbelieve and this Commission is of the view that complainant has succeeded in proving his case and he is entitled to have the decree as prayed for.
Hence, it is,
O R D E R E D,
that the instant C.C. Case No. 75/2020 be and same is allowed on exparte against OP/Bank.
The OP/Bank is here by directed to pay Rs. 4,706/- to the complainant with an interest @ 8% p.a. since 18/10/2019 till realization of the full amount.
The OP/Bank is further directed to pay cost of Rs. 5,000/- to the complainant toward mental agony and harassment.
The OP/Bank is further directed to pay litigation cost of Rs. 5,000/- to the complainant.
Let a copy of this order be given/handed over to the parties to this case free of cost.
