  1. Complainant’s case in brief is that he purchased Jivan Saral Policy of LIC and as per agent annual premium was Rs. 6005/- to be paid for 10 years and in case of death Rs. 1,25,000/- was to be paid and in case of maturity Rs. 1,06,452/- was to be paid as maturity benefit with loyalty addition but on maturity only Rs. 27,939/- was paid to the complainant and Rs. 78,513/- was to be paid which has not been paid hence this case has been filed for direction to the O.Ps. to pay Rs. 78,513/- with 18% interest and also to pay Rs. 20,000/- as compensation and Rs. 15,000/-  as litigation cost.
  2. O.Ps. appeared and have not filed W.S. hence they have been debarred from filing W.S. vide order dt. 08.07.2022 but later on O.Ps. have filed written notes of argument on 27.08.2022. As per O.Ps. all payments have been made as per terms and conditions of the policy bond and nothing is due to be paid to the complainant.
  3. On perusal of the policy bond it is apparent that maturity benefit Rs. 19,745/- was to be paid in case of maturity of the policy along with the loyalty bonus. It is admitted fact that Rs. 27,939/- has already been paid to the complainant on 18.09.2020. Therefore, it is apparent that as per policy bond payment has already been made.
  4. Therefore, we are of the view that mere on the basis of unauthentic paper no right will accrue to any one to make any claim. Therefore, in our opinion claim is not maintainable as per terms and conditions of the insurance policy under question.
  5. Accordingly in light of above discussion case is being dismissed and in the facts and circumstance of the case parties shall bear their own costs.
