None present on behalf of the petitioner / o.p. but they were filed the statement as per direction.

None present on behalf of the complainant. But it appears from the record that the complainant filed this case for claiming amount of Rs.380/- . It appears from the bank statement that o.p. Central Bank of India already refunded the said amount of Rs.380/- to the complainant and credited in to the bank account of the complainant, for this reason o.p. bank filed  this MA application stating that  this claim case has not been maintainable.

Hence, MA/19/2021 be allowed as the main grievance of the complainant is that the o.p. unauthorizedly deducted Rs.380/- from his account and filed this case for refund of the amount.

Accordingly, the bank authority refunded the amount and which is credited to the account of the complainant.

Hence, in my view, though complainant absent before me, this case has no cause of action at all as bank  authority already credited the amount of Rs.380/- as per prayer of the complainant.

Hence, it is

                      O R D E R E D

That the complaint case be and the same is disposed of without any further order and the MA/19/21 also disposed of accordingly.
