The complainant has filed this case against the O.Ps for Redressal of his grievances under the Consumer Protection Act,1986(Act in short) in terms of her prayer made in the complaint petition. The allegation made in the complaint is with regard deficiency in service provided and unfair trade practice adopted by the O.Ps.
After completion of necessary formalities, the O.Ps provided a land line telephone bearing No.06712357920 connection to her premises.The complainant continued to avail the said facility on payment of the bills.
In the month of January,2015 the telephone connection was disconnected and the telephone became dead.The complainant lodged a complaint before the local telephone exchange of the O.Ps intimation to the concerned line man who repairs the defects in the telephone connection.The officer of the telephone exchange did not take any step to restore the telephone connection.The complainant on 26.3.15 made a representation to the O.P No.1 for Redressal of her grievance who forwarded the same to O.P.2 for necessary action.Copy attached as Annexure-1.The O.Ps issued a payment advice refunding Rs.934/- only to the complainant through a cheque bearing“No.025873” dt.01.11.2016 payable at ICICI Bank Ltd. for the said amount which is filed herewith and marked as Annexurfe-23 series.
The complainant was in need of telephone connection instead of depositing the cheque under Annexure-2 for encashment, she approached the officer’s of the local telephone exchanges for restoration of her land line connection but the O.Ps remained silent and on enquiry she was told that the land line connection cannot be restored for which deposit made by her has been refunded.Due to the aforesaid action of the O.Ps she suffered from mental agony and is facing a lot of inconvenient.So, the complainant prayed that the O.Psmay be directedto restore the land lined telephone connection bearing telephone No.0671-2357920 to the premises of the complainant and pay sum of Rs.20,000/- (twenty thousand) only with future and pendentilite interest of 18% per annum to the complainant.
The O.Ps further stated that the O.P No.3 made verification and found that the residence of complainant is about 5.3 Kms from Katikata exchange.The cable from Katikata to Asureswar is manageable.The cable from Asureswar Bazar to Luna River is good.The length of Luna Bridge is about 700 Mtrs.50 pairs of cables laid by BSNL Long ago have been severely damaged and some cables were theft by anti-socials.So, few telephone connections on the other site the river were disrupted.Complainant’s residence is about 1.2 Km distance from Luna river and 600 mtr. cable at the other site of river were damaged which required new laying for which huge amount is required to be invested for a single consumer and return from the projectfar below and BSNL will face heavy loss.When a telephone connection lies disconnected for long time, TRA finalizes the account adjusting the outstanding bill with security deposit and refunds the balance amount.Further O.Ps stated that the complainant has not conveyed the change of her name.
ORDER
The case is allowed on contest against the O.Ps. The O.Ps are directed to pay Rs.20,000/- along with interest @ 8% per annum from the date of filing of the case within 45 days from the date of receipt of copy of this order.
