Parties are present .

The ptn filed by o.p regarding maintainability of the case is taken up for hearing .

The ld advocate for o.p submits that the complainant filed this case against the o.p stating interalia that he obtained Telephone as well as Broad Band Connection from the office situated at Bidhannagar , Salt Lake , at the residence of the complainant is also situated outside the jurisdiction of this Forum.

In view of the said fact ,the ld advocate for o.p submits that the case is to be dismissed on the ground that the same is not maintainable since this case does not have territorial jurisdiction .

The complainant submits that since the Head Office of BSNL is situated within the territorial jurisdiction of this Forum , therefore the case is quite maintainable .

Considering the submission of the respective parties , it appears that the BSNL connection was obtained from the office of the BSNL, situated at Bidhan nagar , Salt Lake .

Since the Head Office is situated at Dalhausee, within Hare Street P.S , cannot create territorial jurisdiction of this Forum.

Accordingly, we hold that the case is not maintainable since this Forum lacks the territorial jurisdiction .

Liberty is given to the complainant to file the case before the appropriate Forum.

In view of the facts and circumstances , the case is dismissed.
