Perusal of the record reveals appeal bearing No.A/04/343 was dismissed for default on 01.10.2008.

Thereafter this Misc. Application is filed by the appellant for restoration of the said appeal.

Perusal of the Order-sheet shows that the applicant / appellant as well as their counsels are absent since 29.09.2009.

The application is summarily rejected for want of jurisdiction under Consumer Protection Act as this Commission has no power to restore the appeal, which was dismissed for default.

In the result this Misc. Application stands dismissed.

No order as to cost.

Inform the parties accordingly.
