F I N A L    O R D E R
1. This complaint is filed by Sri Kishore Acharjee of Charilam, Sipahijala, Tripura against the O.P. namely (1)The Chief Executive Officer, Happy Easy Go. Corporate Agent of Indigo Airlines, India & (2)Sri Abhijit Poddar, Owner of Sri Sai Baba Tour & Travels, Agartala, Tripura, alleging deficiency of service on the part of the O.Ps.
1.1 The fact in short is that the complainant  booked air ticket for a price of Rs.3692/- from Abhijit Poddar, the Sub-agent of 'Happy Easy Go' Air Travels, a Corporate Agent of Indigo Airlines for the purpose of going to Kolkata on 09.10.2021. Lateron on 27.09.2021 the complainant contacted Abhijit Poddar, the proprietor of Sai Baba Tour & Travels, Agartala to defer the journey to Kolkata. But Abhijit Poddar informed that the price of deferred ticket would be Rs.10,000/- as such the complainant advised Abhijit Poddar to cancel his tickets and contacted Indigo Authority who informed the complainant that the price of his air ticket will be refunded back through the agent. 
1.2 Lateron on different dates the complainant contacted the sub agent who repeatedly informed that Happy Easy Go, the Corporate Agent of Indigo Airlines did not refund the amount to him. As such the complainant sent one mail to Happy Easy Go which was replied on 14.09.2022 with request to the complainant to communicate PNR. Accordingly the PNR was communicated. Thereafter the complainant time and again contacted the 'Happy Easy Go' and on 29.08.2023 the complainant was asked to communicate his bank details which was duly communicated. 
1.3 Notice was sent on 04.08.2023 but to no good. On 29.08.2022 over telephone Indigo authority informed that shortly his payment will be made, but in vain. Hence this complaint.
2. Summons were issued upon Happy Easy Go but they failed to appear. The Sub agent Abhijit Poddar was added as O.P. No.2 and being served with summon he also did not appear as such, the case has been proceeded exparte against both the O.Ps vide order dated 04.12.2023.
3. The complainant has submitted evidence on affidavit with copy of Air ticket, copy of mail, copy of notice served upon the O.P. No.1.
4. We are satisfied about the statement and documents of the complainant that inspite of the fact that the air ticket of the complainant was cancelled, the O.P. No.1 and O.P. No.2 have failed to refund the amount by deducting cancellation charge, if any. However, being served upon notice from this Commission the O.Ps have not appeared. Abhijit Poddar, the O.P. No.2 have deposited the amount of Air ticket to the account of the Happy Easy Go, which is also clear from the statement and documents submitted by the complainant. Hence, we are satisfied that Happy Easy Go, the Corporate agent of Indigo Airlines is guilty of deficiency in service as it has failed to refund the amount to the complainant.
5. In the result, it is directed that the Chief Executive Officer, Happy Easy Go, the Corporate Agent of Indigo Airlines shall refund the amount of Rs.3,692/-  with interest @ 7.5% P.A. From 09.10.2021, the date of schedule journey till the date of actual payment with further amount of Rs.10,000/- which is compensation and inclusive of litigation cost. 
6. The case stands disposed off.
7. Supply 3 copies of this order to the complainant. The complainant shall sent one copy to Abhijit Poddar and another to the Chief Executive Officer, Happy Easy Go.
