ORDER   Appellant Rama Bind as well as his counsel are absent. Adv.Quazi for Respondent is present. As both parties were absent since long, on   12/12/12 fresh notice was issued to both of them, and Respondent appeared through Adv.Bharade in response to the notice on last date, but today he is also absent. But no report about service of notice is received. On perusal of the office copy of the notice it reflects that it was issued on the correct address of the appellant as shown in the appeal memo as well as in complaint. Therefore it will have to be presumed that the appellant is served with notice. But the appellant did not turn up. Hence there is no alternative than to dismised the appeal in default. Accordingly the appeal is dismissed in default. No orders as to costs.
