1.               The instant case was filed by complainant U/S 12 of the C.P. Act, 1986 wherein the complainant has  prayed for direction upon the o.ps. to extend the sanctioned plan to enable him to construct the 1^st floor and to pay compensation of Rs.10,000/-  together with other reliefs as the O.Ps. in spite of repeated requests did not extend the same.

2.               The o.ps. in their  written version contended interalia that as per the resolution dated 14-05-2010 no renewal can be granted by way of extension.

3.        Upon pleadings of both parties two points arose for determination :

i)          Is there any deficiency in service on the part of the O.Ps.  ?

ii)                  Whether the complainant is  entitled to get any relief as prayed for ? 

DECISION  WITH   REASONS      :

4.               Both the points are  taken up together for consideration. Admittedly the sanctioned plan was extended till 2004. For financial stringency and family mishap, the complainant could not raise the upper floor construction. If the plan is further extended to enable the complainant to construct the 2^nd storey what harm the O.Ps. are going to sustain is beyond any contemplation. It was sanctioned by the O.Ps. once and further extended till 2004. The O.Ps. now cannot take a convenient stand to repudiate his prayer. In our considered opinion, it is a fit case where the prayer of the complainant shall be allowed.

           Both the points are accordingly disposed of.

O     R     D      E      R      E        D

      That the C. C. Case No. 46 of 2013 ( HDF  46 of 2013 )  be  and the same is allowed on contest but without costs.  

      The O.Ps. be directed to extend the plan  no. B.R.-165/B5 dated 16-06-2001 for a further reasonable period after receiving the requisite fees within 30 days from the date of this order.

      No order as to compensation and litigation costs.

      Supply the copies of the order to the parties, as per rule.
