The complainant has filed this case stating interalia that due to non availability of connecting train from Chennai to Ernakulum junction they had to avail of road transport. As such, the complainant has filed this case for refund of fare.

On perusal of the record we found that South Eastern Railway has not been made party and the Chief Commercial Manager agreed to pay the proportionate fare of Rs.1900/- but the said has not been accepted by the complainant by submitted that the said order was issued in the name of another person. The complainant ought to have made the said person as a party to this case.

Since the case is riddled with so many defects therefore we are not in a position to issue process agasint the o.p. and accordingly, it is hereby ordered,

That the case be dismissed in limini.
