This appeal is filed against the judgment of the District Forum, Jaipur 2^nd dated 10.12.2018 whereby the complaint of

the appellant is dismissed. The matter has come upon application u/s 5 of the Limitation Act as the appeal is filed with delay of 25 days. Looking at the facts mentioned in the application the delay is condoned.

 

The contention of the appellant is that he could not travel on the issued ticket and he is entitled for the refund.

 

Heard the learned counsel for the appellant and perused the impugned judgment.

 

The Forum below has rightly held that in view of sec.13 & 15 of the Railway Claims Tribunal Act in the matter of refund of ticket consumer complaint was not maintainable and further more it is not in dispute that the appellant has applied for cancellation of ticket after three days which was rightly not been entertained by the respondent.

 

In view of the above, there is no merit in this appeal not worth admission and stands dismissed.
