15/07/2015 - The reasons for delay in disposal of this appeal can be seen from the order sheet.
Inspite of fixing this case for passing ex-parte order, nobody appears for the parties.
It appears from the order dated 20.02.2014 that a prayer was made for filing substitution petition on behalf of the Complainant/ Respondent. Thereafter inspite of granting seven opportunities, substitution petition was not filed, on behalf of the Respondent.
Then on 26.03.2015, on the prayer of the appellant time was granted for filing substitution petition. Time was granted thrice to enable the appellant to file substitution petition.
Thus it appears that in terms of O 22 R 10-A CPC, the Respondent’s counsel informed that the Respondent has died, but did not file substitution petition.
Then it was the duty of the appellant to file substitution petition. But, as noticed above, inspite of sufficient opportunity it was not filed.
In the circumstances this appeal stands dismissed as having abated.
