ORDER NO. 1 DT. 13.7.09

HON’BLE MR. JUSTICE A.CHAKRABARTI, PRESIDENT

After hearing the Ld. Advocate for the Appellant as it appears that the only grievance of the land-owner/Appellant against the impugned order is that the owner having executed a Power of Attorney in favour of the Developer, the Developer is entitled to execute and register the Deed of Conveyance.  It appears from the impugned order that no compensation has been provided until the JDRs fail to comply with the order.  Therefore, we do not find any contention made which requires a consideration by this Commission in the Appeal and the contentions show themselves that there is nothing to interfere with the impugned order.  There cannot be any denial that the land-owner is also bound to execute and register the Deed of Conveyance along with the Developer in view of the agreement.  In such circumstances, we do not find any ground to interfere with the impugned order and the Appeal fails and is hereby dismissed.
