This revision is directed against the following interim order of the State Commission, Delhi in original complaint No.C/7/2012: - -2- “Matter adjourned for final arguments subject to the payment of costs of Rs.10,000/- each by OP1, 2 & 3 to the complainant by way of cheque. Re-notify the matter for final arguments for 26.11.2014.” Learned Shri Punit Bhalla, Advocate for the respondent/complainant at the outset has submitted that he actually intimated the State Commission about the telephonic call received by him from the petitioner showing his inability to appear before the State Commission because of a theft having taken place at his premises. In view of the aforesaid he states that he has no objection if the revision petition is allowed and the impugned order imposing cost is set aside. Learned counsel for the respondent, however, submits that the complaint is pending for the last two years, therefore, directions be issued to the State Commission to hear the arguments on the date already fixed in this regard. In view of the above-noted facts and circumstances of the case and the concession given at the Bar, revision petition is allowed, impugned order imposing cost is set aside with the direction that the State Commission should hear the arguments on 26.11.2014 the date already fixed there and dispose of the matter at the earliest. -3- Parties to appear before the State Commission on 26.11.2014, the date already fixed. |
