Dr. Parminder Kaur vs. Chesa Dental Care Services

Present:       Sh. Kush Wadhwa, Advocate for the complainant.                                            

                                               

                   Ld. counsel for the complainant got recorded his statement to the effect that he withdraws the present complaint on technical ground and sought permission to file the fresh complaint and to exempt the period of limitation.

                 In view of statement of ld. counsel for the complainant, the present complaint is hereby dismissed as withdrawn. However, the complainant shall be at liberty to file a fresh complaint on the same cause of action in the competent Court of law, as per provisions of law. The original documents, if any, be returned to the complainant as per rules. Complainant will also be entitled to the benefit of the provision of Section 14(2) of the Limitation Act for the period during which proceedings under the Consumer Protection Act remained pending before this Commission. The liberty is granted in terms of the judgment of Hon’ble Supreme Court of India in the case titled “Luxmi Engineering Works Versus PSG Industrial Institute, reported in 1995(2) SCC, page 583”. Copy of this order be supplied to the complainant free of cost.  File be consigned to record, after due compliance.
