Complaint under Sec.12 of the CPA 1986 as amended upto date

The complainant had purchased a refrigerator from OP1 on 17/2/2010.  It had been warranteed for a period of one year.  On 27/4/2012, she had got the refrigerator repaired from M/s Shri Balaji Services , Kingsway Camp, New Delhi.  It is alleged by the complainant that even after the repairs, the refrigerator did  not work satisfactorily.  Hence, the complaint.

     Both the OPs have been proceeded with Ex-parte.

     We have heard arguments advanced at the bar and have perused the record.

     Admittedly, the refrigerator is  out of warranty as it was purchased in the year 2010. Op1 is merely a dealer  who had sold away the machine to the complainant.  The complainant has not impleaded M/s Sh. Balaji Service,s Kingsway Camp as an OP in this case.  No orders can be passegainst OP1 and OP2 as the machine is already out of warranty. Therefore, the complaint has no merits and is hereby dismissed.

Copy of the order be made available to the parties as per law.

File be consigned to record room.
