:  Today is fixed for filing show cause by the complainant as to why the case shall not dismissed due to non prosecution. It appears from the case record that the complainant was absent without steps  on 26.7.2019 so this Forum vide its order dated 26.7.2019 directed to file show cause as to why the case shall not be dismissed due to non prosecution. Today on repeated calls the complainant found absent and no steps taken on his behalf. The opposite party is also absent on calls. But it appears from the case record that the complainant has been praying time for filing written argument since 12.10.2018. After perusing the complainant petition it appears that the complainant filed the instant complaint before this forum praying directions upon the opposite party as incorporated in the prayer portion of the complaint petition for deficiency of service. But the conduct of the complainant shows that he failed to file written notes of argument on the dates and also failed to file show cause today.  As such it may presume that the complainant is not interested to proceed with the case. So this Forum is constrained to dismiss the case for non prosecution. 

 Hence it is ordered that the complaint case being No.C.C.60 of 2015 be and the same is dismissed due to non prosecution.
