ORDER

Learned counsel for petitioner during the course of argument submitted that pursuant to the impugned order of the State Commission, Chandigarh, petitioner has already paid a sum of Rs.2,76,533/- to the respondent/ complainant on 26.4.2013 after adjusting the salvage value of the vehicle against the amount awarded to the respondent against the insurance company. Learned counsel for the petitioner has offered to pay the balance amount provided salvage is returned. Learned counsel for the respondent on instructions states that the respondent is not in a position to return the salvage of the insured vehicle to the petitioner. Therefore, he is satisfied that a sum of Rs.2,76,533/- has been received from the insurance company and he submitted that the difference between the amount awarded and the amount received may be treated a value of the salvage and the claim of the respondent under the complaint may be treated as fully satisfied. Learned counsel for the petitioner states that above offer of the respondent is accepted to the petitioner and requests for disposal of the revision petition in terms of the statement of the counsel for the respondent. In view of the above, the order of the State Commission is modified and the compensation awarded to the respondent is reduced from Rs.3,73,269/- to Rs.2,76,533/- because the respondent admittedly has not returned the salvage of the damaged vehicle and the parties have agreed that the difference of amount of Rs.2,75,533/- already paid to the petitioner and the compensation awarded by the State Commission may be treated as value of the unreturned salvage. The revision petition is disposed of accordingly.
