Consumer Complaint No.366 of 2011

PRESENT:

 

Complainant in person alongwith his counsel Sh.Tarunjit Singh Grewal, Advocate.

Sh.N.P.Sharma, Counsel for OP.

 

Dated the 21st day of August, 2012

 

ORDER

1.         The complainant alongwith his counsel has made the following statement, recorded separately:-

“The complainant agrees to lodge a DDR with respect to the loss of the original sale letter(form 21) with the concerned Police Station and also to furnish an affidavit to the effect that the said motor cycle has never been involved in any criminal offence since the date of its sale on 17.10.2010 till date. Further, the complainant will handover the originals of all the documents, which are in his possession, to the OP to get the motor cycle duly registered. The copy of the DDR and original affidavit shall be handed over to the OP within seven days of today i.e. by 28.08.2012. The complainant shall take the motor cycle to the registering authority alongwith OP at the time of filing for registration”

 

2.         Counsel for OP has made the following statement, recorded separately:-

“The OP undertakes to complete the file for registration of the motor cycle of the complainant after the receipt of the DDR as also affidavit from the complainant, alongwith all necessary documents, within a period of seven days from 28.08.2012. Further, the OP undertakes to bear the charges payable to the registering authority for the registration of the motor cycle. However, the OP shall be depending upon the complainant wherever and whenever he is required being the owner of the motor cycle for the submission of the file with the registering authority”.

 

3.         The complainant alongwith his counsel has made the following further statement, recorded separately:-

“I have read the statement of counsel for OP and withdraw my complaint being fully satisfied”

 

4.         In view of the statement made by complainant alongwith his counsel, this complaint is dismissed as withdrawn being fully satisfied.

5.         The parties shall be bound by the statements made before this Forum.

6.         Certified copy of this order be communicated to the parties free of cost. After compliance file be consigned.
