ORDER

Respondent took admission in the petitioner’s institution for the first PUC and paid a sum of Rs.40,000/-.  Since the subjects ‘Computer Science’ and ‘Hindi’ were not introduced, respondent sought to withdraw from the institution and asked for Transfer Certificate as well as refund of the amount deposited by her along with interest @ 12% p.a.  Rs.15,000/- were claimed towards mental agony and costs of litigation.

          District Forum allowed the complaint and directed the petitioner to refund the sum of Rs.35,000/- to the complainant within one month from the date of receipt of copy of the order, failing which the amount was to carry interest @ 6% p.a. from the date of order till realization.

          Not satisfied with the order passed by the District Forum, petitioner filed the appeal before the State Commission which has been dismissed by the impugned order.

          We agree with the view taken by the fora below.  Petitioner did not introduce the subjects Hindi and Computer Science.  Respondent, under the circumstances, was justified in seeking the Transfer Certificate to enable her to join some other institution and the amount paid by her.  No merits.  Dismissed.
