- With the concent of the parties, the appeal is taken up for final disposal.
- The order under challenge is dated 5.6.2014 by which the appellant herein i.e. OP before the District Forum has been proceeded ex-parte and his defence is stuck up.
- We have gone through the application. In view lof the reasoning given in the application for non-appearance on 5.6.14 as well as no objection given by the respondent, the order dated 5.6.14 is recalled and appellant/OP is allowed to participate in the proceedings before the District Forum subject to the costs of Rs.3,000/-.
- The matter is stated to be listed before the District Forum on 17.12.2014. On the said date the appellant/OP shall pay the costs of Rs.3,000/- to the respondent/complainant and shall also file his written version on the said date. Thereafter, the District Forum shall proceed further the matter in accordance with the law.
- Appeal stand disposed of accordingly.
- Since the matter has been remanded back to the District Forum, the FDR deposited by the appellant/OP before this Commission be released to them after completion of due formalities.
- A copy of this order as per the statutory requirements be forwarded to the parties free of charge and also to the concerned District Forum and thereafter the file be consigned to Record Room.
