            Heard Adv.Choube for the appellant and Adv. Meshram for the Respondent. This is an appeal filed by Union of India against the award passed by District Forum, Chandrapur by majority decision whereby the complaint was allowed and the appellant department is directed to pay the Recurring Deposit amount to the Respondent/complainant alongwith interest @9% p.a.. Two Recurring Deposit books were in the name of deceased father of the Respondent and after his death, the Respondent is shown to be legatee as per will. The will has been produced on record before the forum. Against the award passed by the Forum, the Union of India and Department of Post has filed this appeal.  There is a delay of 105 days in filing this appeal. However, in the delay condonation application bearing No.MA 391/10, the delay is not properly explained. The reasons for the delay made out in the application are baseless and are not inspiring us to condone the delay. Therefore, we are not inclined to allow the MA No.391/10 for condoning the delay of 105 days. Hence we pass the following order.

M.A. No.391/10 stands rejected. Consequently, appeal does not survive for consideration.
