ORDER

By ADV. RAVI SUSHA, MEMBER This is a complaint filed by the complainant to get the floor of the house, newly layed marble with proper case and for other reliefs.. The averments in the complaint can be briefly summarized as follows: 1st complainant entered into a contract between the opposite party for laying marbles with Hydraulic machine for Rs.22/- per sq. feet in his brother’s newly constructed house. But the opp.party did not lay marbles as per the agreement. Hence the complainants filed this complaint for getting relief. Opp.party dared not to turn up. He remained absent and therefore he was set exparte. The 1stcomplainant examined as PW.1 and marked Ext.P1 and P2 From the evidence of PW.1 and Ext.P1 and P2 we find that there is deficiency in service on the part of the opp.party and as such the complainant is entitled to get relief for deficiency in service committed by the opp.party. In the result the complaint is allowed directing the opp.party to pay Rs.50050/- with 9% interests. The opp.party is also directed to pay Rs.50,000/- as compensation.
