As per the office report, Respondent No.2 has been served. However, no one has put in appearance on its behalf. Accordingly, the said Respondent is proceeded against ex parte. We are happy to note that during the pendency of the Revision Petition, the parties have amicably sorted out their differences. As a goodwill gesture, the Petitioner Company has offered to pay to the Complainant a sum of ₹50,000/- provided the Complainant withdraws his allegation of inferior quality of cement supplied to him by the Petitioner Company. Learned Counsel appearing for the Complainant states that as per her instructions, the Complainant is willing to withdraw the said allegation. In view of the above, the Revision Petition is disposed of with the direction that the Complaint filed by the Complainant, giving rise to the present case, shall stand dismissed on Petitioner’s remitting to the Complainant a sum of ₹50,000/- by means of a Demand Draft in his favour within two weeks from today. On receipt of the said amount, both the parties shall not be left with any claim against each other. The Revision Petition stands disposed of, in the above terms. |
