Sh. Suresh Gautam, learned counsel for the revisionist has moved an application with a prayer that the revisionist be permitted to withdraw the revision petition.

In the withdrawal application, learned counsel for the revisionist has stated that this revision petition was filed by the revisionist – The Oriental Insurance Company Limited against the order dated 28.08.2015 passed by the District Forum, Chamoli in consumer complaint No. 31 of 2011 and the said consumer complaint has been finally decided by the District Forum vide order dated 26.10.2015.  As such, the revision petition filed by the revisionist – insurance company against the order dated 28.08.2015 has become infructuous and hence the revisionist does not want to press the revision petition and the revisionist is now filing the appeal against the final order dated 26.10.2015 passed by the District Forum, thereby deciding the consumer complaint.

The application is allowed.  The revision petition is dismissed as not pressed.
