Today learned counsel Smt. Anjali Gusain alongwith her associate Sh. Deepak Kumar Sati for the appellant has appeared whereas learned counsel Sh. Anuj Sharma for respondents alongwith Smt. Chandra Devi, Sh. Surendra Dutt and Sh. Gajendra Dutt – respondent Nos. 1, 2 & 3 has also appeared.
It is alleged that the respondent No. 4 - Sh. Rajendra Dutt is residing out of country, hence the above compromise is verified by his counsel, who is present in person before the Commission.
The above compromise has jointly filed by the parties to the appeal. The signatures of the parties have been identified by their concerned counsel. The compromise has been explained and read over to the parties alongwith their counsel who after persuing, reading and understanding the compromise, endorsed thereupon and admitted it. On behalf of respondent No. 4, the above compromise has been accepted by his respective counsel.
As the compromise has been accepted and endorsed by the parties and their counsel, the compromise is accordingly accepted.
Appeal is decided accordingly in terms of compromise. The awarded amount Rs. 8,48,000/- (Rupees Eight Lacs Forty Eight Thousand only) shall be paid to the respondnets equally within a period of 45 days from today, failing which the respondents shall be entitled to get simple interest @ 8% per annum from today till its actual realization. No order as to costs.
A compromise (paper No. 72) shall form part of the decree. No order as to costs.
Statutory amount, if any, deposited by the appellant be returned to the appellant as per rules and law.
File be consigned to the record room alongwith copy of this order.
A copy of this order alongwith compromise and original file be sent to the District Commission concerned for perusal and necessary action.
